Khaliphani Phugeni, MDC The Supreme Court today ruled that Nelson Chamisa is not the legitimate MDC.

The Supreme Court upheld the High Court Judgement of Justice Mushore and ordered that:


– Third respondent (MDC) convene an Extraordinary congress within 3 months to elect a new president.


– Failure to do so Morgan Komichi will have to call for the extra ordinary congress as the Chairman of the party.

Thokozani Khupe is now the acting president.

The judges were Paddington Garwe, Patel and Guvava

The ruling follows an appeal by MDC-Alliance leaders Chamisa and Morgan Komichi challenging a High Court ruling in May last year which declared that Chamisa was illegitimately acting as the party leader.

During the appeal hearing last October, Dr Khupe was represented by Lovemore Madhuku.

Morgan Komichi immediately accepted the ruling and announced the new structures.
