.Nelson Chamisa, has asked all members to disengage from all anti-2030 groups led by Jameson Timba and said this is a waste of time. Chamisa, who is opposed to 2030, has said that there is no need to waste time on the anti-20030 agenda as it is a waste of time.

2016–2017: The IVF Procedures

  • The Procedure: A Black couple from Ballito undergoes IVF at the Care Clinic. The clinic tells them they had three viable embryos, all of which would be used.
  • The Births: In May 2017, the Ballito couple gives birth to a daughter. One month later, an Indian woman—who was a patient at the same clinic—gives birth to a boy with “African features.”
  • Initial Settlement: Realizing the error, the Indian birth mother sues the clinic and enters into a confidential settlement.

2018–2019: Disputed Consent

  • The “Remaining Egg”: In March 2018, the clinic contacts the Ballito couple, claiming they have a “remaining egg” and asking for consent to donate it. The couple reluctantly signs, unaware that a child (the boy) has already been born from their genetic material.
  • Paperwork Discrepancies: The clinic later asks the couple to sign documents “ex post facto” (after the fact) stating they had only used two embryos and donated the “spare” ones.
  • The Meeting Request: In March 2019, the clinic informs the Ballito couple that the recipients of their “embryo” want to meet. The couple refuses.

The Discovery and Investigation

  • Confrontation: The Ballito wife approaches the birth mother at her workplace, leading the birth mother to initially seek a protection order against the couple for “harassment.”

The Legal Battle (Current Status)

  • The Demand: The Ballito couple approaches the High Court in Durban to compel a DNA test. They state they currently only want “legal certainty” to sue the clinic, not necessarily to take custody of the eight-year-old boy.
  • The Birth Mother’s Stance: Initially opposed to the test, the birth mother eventually agrees to it in court, though she maintains she is the only mother the boy knows and should keep custody.
  • The Court’s Ruling: Judge Peter Olsen declines to grant the DNA test immediately. Instead, he appoints a curator ad litem (an independent legal representative) to investigate and report on what is in the best interest of the child.
