
Court Ruling: No Marriage Between Sonja Madzikanda and Wicknell Chivayo

The Zimbabwe High Court, led by Justice Amy Tsanga, ruled that Sonja Madzikanda was never legally married to Wicknell Chivayo.
Key Points of the Ruling
- No valid marriage exists — or ever existed — between the two.
- Madzikanda cannot claim:
- Spousal maintenance
- Division of marital assets
- A formal divorce (since there was no marriage)
- Chivayo had argued that even if a customary marriage had existed, it ended in 2024 when he paid and she accepted gupuro (the traditional divorce token). The court did not need to decide that, because it found no marriage at all.
Sonja Madzikanda’s Reaction (via Instagram Stories)
“Today, the judgment was made final. The court decided that I have never been married… but that’s okay.”
She also expressed frustration and sadness, asking:
“Why have the kids? Why involve your relatives? Why have the ceremonies? … when someone can later say it never happened?”
She called the ruling “a sad day for our culture and our history” and announced she would share her story in videos to warn other women.
Important Distinction – Child Maintenance Is Still in Place
This “no marriage” ruling is separate from an earlier April 2026 consent order (also issued by Justice Amy Tsanga).
- Under that order, Chivayo agreed to pay US$5 million in child maintenance for their two children.
- $2.2 million has already been paid; the rest is due shortly.
- That child support agreement remains in effect and is not affected by the ruling that there was no marriage.
