The five-judge SCA panel closely questioned the family’s legal team, pointing out a lack of explicit, written instructions from Edgar Lungu stating that he wished to be buried in South Africa — even if he did not want his successor involved.

The Zambian government’s counsel, Ben Stoop, maintained that the family is violating a binding initial agreement made on 14 June 2025, where they originally agreed that President Hakainde Hichilema would host the state funeral and receive foreign dignitaries.

By prior agreement pending this appeal, Lungu’s body was transferred to a mortuary in Pretoria East, with the Zambian government covering the storage costs. The family retains supervised access to the body until the SCA issues its final, definitive order.
