Allegations by the Applicants
The applicants make several serious allegations, suggesting foul play and misconduct:
-
Fraudulent Seizure of Custody: That Irene Machiri, Gerald Machiri, Tichaona Mupasiri, and Nomusa Ramushu used a fraudulent affidavit (from Gerald Machiri, who was not treating Mutumwa) to obtain the court order that placed Mutumwa in Pioneer House.
-
Suspicious Circumstances of Death: They raise concerns that Mutumwa’s death may not have been wholly natural, noting contradictions in his reported condition (said to be recovering vs. scheduled for serious surgery) and the unusual rush to bury him.
-
Illegal Detention and Neglect: That from March 2025, Mutumwa was isolated at Pioneer House, denied family visits and essential medical rehabilitation, which constituted inhumane treatment and violated his rights.
-
Questionable Motives & Financial Suspicion: They question Nomusa Ramushu’s sudden appearance as a “life partner” of 44 years (contradicting his known marriage to Thokozile Mawere) and demand disclosure of any life insurance policies on Mutumwa. They also allege funds were spent on litigation rather than his care.
-
Defamation and Harassment: The applicants claim the respondents falsely accused the Mawere family of wanting to harm Mutumwa to justify the ex parte order, and that the family was harassed (e.g., via fake ambulance calls).
-
Violation of Customary Law: They assert that the planned burial, orchestrated by Nomusa Ramushu without clan consultation, violates their Shona/Dziva totem customs, which require burial at the ancestral home in Mawere Village, Zimbabwe.
Core Legal Plea: The applicants argue that justice requires a pause to the burial to allow for a proper investigation into these allegations before Mutumwa is interred.
