📰 Charge Sheet: Fraud and Obstruction of Justice Cases

 

This document compiles the charges and circumstances from the Request for Remand (Form 242) and the Outline of State Case, involving multiple accused persons in separate but related matters.


 

🏛️ Fraud Charges: State vs. Walter Magaya & Others

 

The primary charge is FRAUD (13 Counts) as defined in Sections 136(a)(b) of the Criminal Law (Codification and Reform) Act Chapter 9:23. The alleged acts occurred between 2016 and 2018.

 

Accused Persons

 

  • Accused (1): Walter Magaya, male, 42 years old. Founder and Owner of Prophetic Healing and Deliverance (PHD) Ministries, and a Director of Plannet Africa Private Limited and Yadah Connect Private Limited.
  • Accused (2): Tendai Magaya, female, 41 years old. Wife of Accused (1) and a Director of Plannet Africa Private Limited and Yadah Connect Private Limited.
  • Accused (3): Plannet Africa Private Limited, represented by Tatenda Chinguwa.
  • Accused (4): Yadah Connect Private Limited, represented by Tatenda Chinguwa.

 

Allegations of Fraud

 

  • Scheme to Defraud: Accused (1), acting in connivance with Accused (2), (3), and (4), hatched a plan in 2016 to defraud PHD Ministries Congregants and the public.
  • Misrepresentation of Land: Accused (1) allegedly misrepresented that they had acquired vast tracts of land (in areas including Norton, Chishawasha, and Kwekwe) for building houses for church members, farming, beekeeping, and mining projects.
  • Financial Structure: The projects were to be administered by Accused (3) and (4).
    • Complainants were told to purchase stands from Accused (3) via monthly contributions.
    • Accused (4) was allegedly responsible for building the houses and running the mining/farming projects, assuring investors of a 50% interest return after six months on those projects.
  • Deceptive Documentation: The accused persons allegedly distributed a pamphlet showing pictures of land and houses they intended to build, quoting Genesis 13 v 9: “A vast land is out there and available to you.”
  • Use of Farming Contract: In 2017, Accused (1) and (2) approached Dr. Gideon Gono for a one-season farming contract at New Donnington Farms.
  • Further Misrepresentation: Accused (1) then gathered congregants who had paid for stands and ferried them to New Donnington Farms, misrepresenting that he was the farm owner and that the land was ready for allocation of residential stands, despite knowing the farm belonged to Dr. Gono. Accused (2) was present and failed to disclose the true owner of the land.
  • Financial Loss: The complainants reported the matter after discovering the farm was not for sale. The total amounts received by the involved entities were:
    • Prophetic Healing and Deliverance Ministries: US$1,600,000 and R5,000,000.
    • Plannet Africa Private Limited: US$27,300.00 total.
    • Yadah Connect: US$21,340.00, ZAR190,000.00, and ZWD 1,000 total.
  • Nothing was recovered.

 

🛑 Obstruction of Justice: State vs. Tapiwa Felix Chikondo

 

This is a separate case of a corporal in the Zimbabwe National Army, Tapiwa Felix Chikondo (34 years old), charged with interfering with the arrest of Walter Magaya.

 

Charges

 

  • Defeating or Obstructing the Course of Justice (Section 184(1)(g) of the Criminal Law (Codification and Reform) Act Chapter 09:23).
  • Alternatively: Assaulting or Resisting a Peace Officer (Section 176 of the Criminal Law (Codification and Reform) Act Chapter 09:23).

 

Circumstances of the Arrest and Obstruction

 

  • Date and Location: The incident occurred on the 1st of November 2025 at approximately 0730 hours, at Walter Magaya’s prayer mountain in Prospect, Waterfalls, Harare.
  • Police Operation: A police team was present at the prayer mountain entrance to arrest Walter Magaya for reported cases of Rape and Fraud.
  • Accused’s Actions: The accused drove his vehicle (a sky-blue Nissan Dayz) at high speed and blocked the police’s stationary vehicle at the boom gate.
  • Confrontation: When police identified themselves, the accused allegedly shouted that the police had no permission to be there and ordered them to leave.
  • Assault: The accused then charged towards Detective Assistant Inspector Chifamba Munyaradzi and pushed him to the ground, hindering the police investigation and the execution of the arrest warrant.
  • The accused was subsequently restrained and arrested, as he was deemed “very violent.”

II. Fraud Charges – Annexure to Form 242 (Circumstances)

The charge is FRAUD (13 Counts) AS DEFINED IN SECTION 136 (a)(b) OF THE CRIMINAL LAW (CODIFICATION AND REFORM) ACT CHAPTER 9:23.

Accused and Representation

  • Accused (1) is Walter Magaya, male, adult, aged 42 years, residing at 168 Smuts Road, Prospect, Waterfalls, Harare. He is the Founder and Owner of Prophetic Healing and Deliverance Ministries (PHD) (an unregistered organization) and also the Director of Yadah Connect Private Limited and Plannet Africa Private (duly registered companies).
  • Accused (2) is Tendai Magaya, female, adult, aged 41 years, residing at 168 Smuts Road, Prospect, Waterfalls, Harare. She is the wife of accused 1, Walter Magaya. She is also the Director of Yadah Connect Private Limited and Plannet Africa Private.
  • Accused (3) is Plannet Africa Private Limited, represented by Tatenda Chinguwa, the Operations Manager at Yadah Connect Private Limited and Plannet Africa Private Limited.
  • Accused (4) is Yadah Connect Private Limited, represented by Tatenda Chinguwa, the Operations Manager at Yadah Connect Private Limited and Plannet Africa Private Limited.

Circumstances of the Offence

  1. Sometime during the year 2016, accused (1) acting in connivance with accused (2), (3) and (4) and other members of the public hatched a plan to defraud PHD Ministries Congregants and other members of the public by misrepresenting that they had acquired land in Chishawasha, Norton, Westgate, Fern Valley Mutare, Bulawayo, Kwekwe, Arcturus, Ruwa, Manyame and Nyatsime for building houses for church members and the general public, for farming, for beekeeping and for Mining projects.
  2. Pursuant to this misrepresentation, in 2016, accused (1) who is the founder of PHD Ministries held a church service at PHD Ministries. He preached a Church Service to the church congregants including the complainants 1-12 and was broadcast live on the Church television screens and Yadah Television channel which was accessed by other members of the public who were not members of PHD Ministries. Complainant 13 was watching Yadah television whilst her home in Harare. Accused (1) misrepresented that he had land available for stands for sale.
  3. During his preaching accused (1) announced that God had instructed him that the purpose of giving him land was to assist members of the church and others to build houses. He further announced that the project of building houses was to be administered by accused (3) and accused (4).
  4. He stated that members who were interested were supposed to purchase the stands from accused (3) paying monthly contributions towards the purchase and accused (4) was to build houses for the stands purchased. In his misrepresentation, the accused persons produced and distributed a pamphlet with the picture of the land purported to have been acquired for the stands by the accused persons and the houses which they said they intended to build for the congregants and general public. Genesis 13 v 9 which says “A vast land is out there and available to you” was inscribed on the cover of the pamphlet.
  5. The accused further misrepresented by advertising mining, farming and Bee-keeping projects which they said would assist members in building the houses and encouraged them to invest in these projects which accused one alleged would be run by accused (4) assuring them that they will get 50% interest after six months for the mining, farming, and bee-keeping projects.
  6. As a result of the misrepresentation, the complainants believed accused (1) and developed some interest in the aforementioned projects. During that same year 2016, the complainants number 1-12 listed in column A of the schedule to the annexure made some payments at the church offices as indicated on column B-D of the schedule totaling amounts stated on column E. The money for the schedule totaling amounts stated on column E. The money for the schedule totaling amounts stated on column E. The money for the stands was paid to accused (3) and for other projects were paid to accused (4).
  7. The accused further signed memoranda of understanding with the complainants where on the preamble, they misrepresented to the complainants that accused (3) had been allocated land by the Ministry of Local Government and public works knowing very well that there was no such land that had been allocated to accused (3).
  8. To keep the defrauded complainants with hope, in 2017, accused (1) and accused (2) acting in connivance approached Dr Gideon Gono seeking a farming contract at New Donnington Farms belonging to Dr Gideon Gono and Dr Gideon Gono agreed to providing them with land for farming for one season only. Accused (2) was in the forefront negotiating with Dr Gono for a farming contract.
  9. Accused (1) well knowing that he had not acquired any land at New Donnington Farms and taking advantage of the farming contract entered into with Dr Gono, gathered church congregants who had paid for the stands including the complainants and ferried them to the New Donnington Farms in Norton and misrepresented that he was the owner of the farm and the farm was ready for allocation of residential stands knowing very well that the farm belonged to Dr Gideon Gono. When the announcement was made accused (2) was present and did not disclose to those who were being shown the land that the land belonged to Dr Gideon Gono as she was part of the team that negotiated for the farming contract.
  10. The complainants later picked information that the farm they were shown belongs to Dr Gideon Gono and was not on sale. They then made a reports to the Police.
  11. Prophetic Healing and Deliverance Ministries received US$1 600 000, R5 000 000, Plannet Africa Private Limited received a total of US$27 300-00, Yadah Connect received US$21 340-00, ZAR190 000-00 ZWD 1 000 and nothing was recovered.

 

🚨 Case: State vs. Tapiwa Felix Chikondo

II. Outline of State Case

 

  1. The complainant is the State being represented by Detective Inspector Mashizha Washington.
  2. The accused is Tapiwa Felix Chikondo, a male adult, aged 34 years, residing at number 283 Unit J, Seke, Chitungwiza. He is employed by the Zimbabwe National Army as a corporal.
  3. On the 1st day of November 2025 at about 0730 hours, a team of police officers comprising Superintendent Ndhlovu, Detective Inspector Mashizha, Detective Inspector Siwela-Vhurepi, Inspector Mashongera, Detective Assistant Inspector Chidumu and Detective Assistant Inspector Chifamba were at the entrance of Prophet Walter Magaya’s prayer mountain during the course of their duty where they wanted to arrest Walter Magaya for reported cases of Rape and Fraud. The other team had gone up the mountain to effect the arrest.
  4. Whilst the police were at the boom gate, the accused came driving his motor vehicle, a sky-blue Nissan Dayz, at a high speed and stopped in front of police stationery motor vehicle, blocking it. He was furious and asked why police officers were at the prayer mountain. Detective Inspector Mashizha Washington produced his Police identity card to him and told the accused that they were all police officers at the place investigating reported cases.
  5. He shouted that the Police officers had no permission to be at the place since the place was his and ordered the police officers to leave. He then charged towards Detective Assistant Inspector Chifamba and pushed him to the ground.
  6. Detective Inspector Mashizha then intervened and restrained the accused person from further assaulting Detective Assistant Inspector Chifamba and then arrested managed him as he was very violent.
  7. The accused person had no lawful right to act in the manner they did.
