Harare Magistrate Feresi Chakanyuka has dismissed Marry Mubaiwa’s application for stay of prosecution.
Mubaiwa had requested to have her prosecution stayed because of her poor health.
“It’s admitted she (Marry Mubaiwa) was sick. She admits in her ruling that she was in hospital. So how it can be said that she is to blame for the delay beats me,” said her lawyer Beatrice Mtetwa.
Marry who faces charges including attempted murder, has been critically ill, with her health significantly deteriorating to the point of losing her right hand and left leg to lymphodema.
