South African Constitutional Court, has dismissed the appeal by Home Affairs Minister Aaton Motsoaledi regarding a High Court ruling on the Zimbabwe Exception Permit.
The Concourt agreed with the High Court that the ZEP had been illegally terminated adding that holders have a right to fair administrative action.
This ruling comes after the Helen Suzman Foundation and the Consortium for Refugees and Migrants in South Africa (Cormsa) challenged the Minister of Home Affairs’ decision to terminate the ZEP under the Promotion of Administrative Justice Act, 2000 (PAJA).
