Access Forex Employees Petition Over Unfair Labour Practices

The employees of Access Forex in South Africa have submitted a formal complaint regarding alleged unfair labour practices, employee neglect, and failure to pay agreed-upon wages.
Their grievances include:
  • Non-payment of basic salaries as stipulated in their last signed contracts (March 2022).
  • Unilateral changes to compensation from a basic salary plus commission to commission-only, without formal written notice.
  • Failure to compensate for work performed on public holidays and Sundays.
  • Lack of formal contract updates or amendments, leaving the employees without clear terms of employment since 2022.
The complaint states that informal attempts to resolve these issues have been ignored by management. This internal issue follows recent external challenges for the company, including administrative sanctions imposed by the South African Reserve Bank (SARB) in October 2025 for non-compliance with the Financial Intelligence Centre Act (FIC Act).

Complaint Regarding Unfair Labour Practices and Non-Compliance with Employment Agreemet 

We, the undersigned employees of Access Forex, are writing to formally raise our concerns regarding unfair labour practices, non-payment of agreed wages, and failure to renew or update our employment contracts as per legal and ethical standards.

We began working for Access Forex in 2020, when the company officially launched. At that time, we were offered a basic salary, incentives, and commission, supported by a one-year contract that included an agreement for possible extension.

In March 2022, we were issued new contracts reflecting an increase in our basic salary to R4,500, plus commission and incentives. The company also committed to compensating us for work performed on public holidays and Sundays. Unfortunately, this commitment has not been honoured, as we have not received any such payments despite fulfilling our duties on those days.

Since March 2025, our situation has worsened. We have not received our basic salary, and there was no written notice, formal statement, or amendment to our contracts explaining the change. We were only verbally informed that we would now receive commission only, with unrealistic sales targets that are almost impossible to achieve.

As it stands, the only valid and signed employment contract we hold is the one from March 2022, which clearly stipulates our entitlement to a basic salary. No formal amendment or termination of this contract has been issued to us, and the company has not engaged with us regarding our employment status. We feel neglected, exploited, and unfairly treated, despite our loyalty and hard work since the company’s establishment.

We respectfully request the following:

1. Immediate payment of all outstanding basic salaries as per our March 2022 contracts.according to south African law every year we must have an increase which they where not doing 

2. Compensation for work performed on public holidays and Sundays as previously agreed.

3. A formal explanation and updated written contract that clearly outlines the new terms of employment (if applicable).

4. Consideration of compensation for the efforts and contributions we have made toward the company’s growth since 2020.

We have attempted to raise these issues informally, but there has been no communication or resolution from management. We therefore submit this formal complaint for urgent attention and fair treatment in accordance with South African labour law.
