Prominent lawyer and politician Fadzayi Mahere has criticized Minister Daniel Garwe’s announcement banning evening vending and the sale of second-hand clothes, arguing it is legally baseless and unconstitutional.

In a post on X (formerly Twitter), Mahere reminded government ministers that press statements are not law, citing Section 68 of the Constitution, which requires administrative action to be lawful, reasonable, and procedurally fair.

“Unless there is a valid enactment underlying your ban, it is invalid and of no force or effect,” Mahere wrote. “This is a constitutional democracy not an unwieldy jungle. Let’s adhere to the rule of law.”

Minister Garwe had earlier said the government was banning informal night-time vending and the sale of second-hand clothes as part of an urban renewal effort.
