Ashley Masendeke a.k.a Mai Jeremaya cross examination in the rape case at the magistrates court.

‎

‎‎”You told the court that you removed your clothes on your own?,” asked Shepherd Makonde, lawyer of the two men accused of rape.

‎

‎”Yes,” Masendeke said.

‎

‎

‎”You told the court that you set on the bed with the accused person,” Makonde asked.

‎

‎”Yes,” Masendeke answered.

‎

‎

‎”Are you the one who removed the bra and the pulling stockings?,” Makonde said.

‎

‎”Yes, I was told to do so,” Masendeke said.

‎‎

‎”He did not jump on you he started fondling your breasts to solicit consent in a romantic moment?,” Makonde said.

‎

‎”It was not romantic, I was crying and was told to stop crying,” Masendeke said.

‎

‎”Is it true that you went on top of him during the sex act?,” Makonde asked.

‎

‎”Yes,” Masendeke said.

‎

‎”Is it correct that you directed his penis into your vagina?,” Makonde said.

‎

‎”Yes, because he had failed, it was painful when he tried to insert his penis,” Masendeke said.

‎

‎”In you statement you said it was Charlie who removed your bra and not yourself.”

‎

‎”Yes,” Masendeke said.

‎

‎

‎”You did not tell the police you removed your bra and stockings on your own according to your police statements?,” Makonde asked.

‎

‎”I did not use those exact words,” Masendeke said.

‎

‎

‎”You did not tell the police that you were the one on top riding the accused person,” Makonde said.

‎

‎”I told them but they did not include it. If I had known that I should include all the nitty gritties I should have done it,” Masendeke said.

‎

‎

‎

‎

‎”Why was it not important for you to tell the police that you assisted the accused person to penetrate you by holding his penis?,” Makonde asked.

‎

‎”I did tell them but not exactly that I was on top. The police said they wanted to know whether there was penetration,” Masendeke said.

‎

‎”From the footage on the laptop you can see that the guard was close to the window in the room you were in. Why didn’t you scream?,” Makonde asked.

‎

‎”I cried and screamed and no-one came to my rescue,” Masendeke said.

‎

‎”Now you took $20. What was it for?,” Makonde said of the money Masendeke was given by Charlie.

‎

‎”I don’t know,” Masendeke answered

‎

‎”You told the court you took the money..why did you take it?,” Makonde asked.

‎

‎”I don’t know,” Masendeke said.

‎

‎”Did you take the money to the police?,” Makonde asked.

‎

‎”No, I didn’t take it to the police.l,” Masendeke said.

‎

‎”I put it to you that you took the $20 because you had agreed to be paid that amount and you used the money for your personal needs,” Makonde said.

‎

‎”That is a lie,” Masendeke said.
