Complainant Eve Rumbidzai Dota Makoni failed to testify after she had filed a rape case against Bright Nyanhete.
The complainant was no show on their first trial date with a warrant of arrest being issued against her.
She failed to testify in court leading to the case being dismissed and Bright Nyanhete has been told that he can fly back to Australia.
