1. Ace Magashule’s assistant, Moroadi Cholota, has been released by a court in the Free State which found that her extradition from the USA was unlawful. Moroadi Cholota was extradited from the USA on Thursday, August 8, 2024. Her extradition was approved by Judge Erin Aslan of the Maryland District Court on June 7, 2024. She was arrested in the US on April 12, 2024. Moroadi Cholota’s extradition was ruled unlawful and unconstitutional by the Bloemfontein High Court on June 3, 2025, because the court found that the South African state submitted falsified documents to US authorities to secure her extradition. Specifically, Judge Phillip Loubser stated that “the prosecution has not found reasonable doubt or at all that there was a valid or lawful request from South Africa for the extradition of Ms Cholota from the United States. It follows that if there was no valid extradition request, then the extradition itself was without any basis and, therefore, unlawful.”
Cholota’s defense argued that the state had made false claims, such as stating she had no intention of returning to South Africa and was a flight risk, and that she had links in Kenya. Her lawyers contended that her address in the US was known and she had responded to official correspondence and met with investigators. The state conceded to some of these falsehoods. This ruling means that the court does not have jurisdiction to try her, and she has been removed from the indictment in the R255 million asbestos corruption case.
