DRAFT ORDER

Having read the papers filed on record and having heard the counsel for the Applicant, the Court makes the following order: –

1. That any non-compliance with the Uniform Rules of Court relating to the forms and service, are dispensed with and that the present application be heard ex parte and as one of urgency.
2. That a rule nisi be hereby issued, calling upon the respondents to show cause, if any, to the above Honourable Court on 22nd of March 2026 at 10h00 or as soon thereafter as the matter may be heard, why the order should not be made final.
3. Pending the finalisation of the divorce action pending before the High Court in Harare in an action brought by the Applicant against the First Respondent under case number HCHF 62/26, the Respondents be and are hereby interdicted as follows:
4. In relation to the First Respondent:
   4.1. The First Respondent is hereby interdicted, restrained and prohibited from dissipating or concealing the joint assets of the matrimonial assets, from performing any juristic act which includes dealing in; transacting in or with, making withdrawals, alienating or acting in any manner that depletes, diminishes or reduces the value of the assets which include movable and immovable property described as follows:
   4.1.1. Money or funds held in the following bank accounts held at the Second Respondent’s Bank:
   4.1.1.1. Money held in the name of IMC COMMUNICATIONS COMPANY REGISTRATION NUMBER 2024/277052/07
   4.1.1.2. Money held in the name of STEMCOR AGRI INTERNATIONAL COMPANY REGISTRATION NUMBER 2024/334392/07
   4.1.1.3. Money held in the name of TRINTAS PETROLEUM COMPANY REGISTRATION NUMBER 2023/983760/07
   4.1.1.4. Money held in the name of WMC TRADING COMPANY REGISTRATION NUMBER 2018/359654/07
   4.1.2. Immovable property held under title of the First Respondent or registered in a Trust or Juristic entity described as follows:
   4.1.2.1. U______ and Maude Street, Sandton, Gauteng, whose further title deed registration particulars are unknown to the Applicant.
5. In relation to the Second Respondent:
   That the Second Respondent is hereby ordered to interdict the performance of any juristic act which has a tendency of removing from, reducing the bank balances of or withdrawal of funds from the bank accounts of the companies mentioned in paragraphs 4.1.1.1 to 4.1.1.4 above.
6. In relation to the Third Respondent:
   That the Third Respondent is interdicted from authorising the alienation, transfer of title or any other juristic act that has a tendency of altering the current title of the property known as L and Maude Street, Sandton, Gauteng.
7. In relation to the Fourth Respondent:
   That upon being notified of the landing, arrival and presence of an aeroplane with the following particulars: Bombardier Challenger 300 Jet, registration number ZS-ACT with serial number 20034, the Fourth Respondent is ordered to restrain, prohibit and interdict the further movement of that aeroplane from its premises at any airport under its control.
8. The application be served upon all the Respondents.
9. Costs of suit.

“This Order is made an Order of Court by the Judge whose name is reflected herein, duly stamped by the Registrar of the Court and is submitted electronically to the Parties/their legal representatives by email. This Order is further uploaded to the electronic file of this matter on Case Lines by the Judge or his/her Secretary. The date of this Order is deemed to be 20 January 2026.”
