RE: ONLINE PUBLICATIONS SUGGESTING THAT THEMBINKOSI MAGWALIBA DRAFTED THE PROPOSED CONSTITUTIONAL AMENDMENT NUMBER 3/2026

I have noted with concern publications on X (formerly Twitter) from 22 February 2026 to today suggesting I am one of the chief architects of the proposed Constitutional Amendment No. 3 which was recently gazetted. In response to these articles, I set out the correct position below.

At no time was I consulted or instructed by the Government of Zimbabwe or any other person to draft the proposed Constitutional Amendment. I therefore took no part in the drafting of the document. I first saw the document when it was gazetted.

There is a suggestion in the publications that I charged fees to the Government of Zimbabwe which have not been paid and I am unhappy about the non-payment of my fees.

The correct position is that not having been briefed, I charged no fees. I am therefore not unhappy on account of the alleged non-payment of fees since no services were ever rendered to anyone in connection with the drafting of the intended law.

I never met Professor Jonathan Moyo with whom it is alleged I drafted the proposed law with, since he went into exile in 2017. I have not had any telephonic contact with him nor have I been in contact with through any other means. I could not therefore have worked with him in crafting the concerned document.

The articles are therefore completely inaccurate and untrue to the extent that they relate to me. I strongly deny the aspersions of having associated with certain wealthy individuals who are alleged to have amassed wealth improperly, contained in the articles.

I am concerned that the articles which have far reaching effects on my professional integrity and my reputation as a person were filed without so much as having been referred to me for my comment. I have no doubt that if that had been done the slanderous statements in the articles would not have been published.

I trust that this statement clarifies the facts surrounding my involvement or rather more accurately, my non-involvement in the drafting of the proposed law.

I further trust that this response will be circulated as extensively as the articles in issue.
