RE: JAY ISRAEL SENIOR // PASTOR ALPH LUKAU & ALLELUIA MINISTRIES INTERNATIONAL NPC
1. We act for Alleluia Ministries International NPC and Pastor Alph Lukau (collectively referred to as “our clients”).
2. We address this letter to you at the instance of our clients who have consulted us regarding the unlawful, false and defamatory allegations/accusations, which are denied, made by you in relation to our clients on, inter alia, 1 and 2 December 2020 as well as in the live Facebook broadcast on 2 December 2020.
3. Our clients have, in addition, consulted us with regards to their rights in relation to, amongst others: –
3.1. the significant damage which our clients have and continue to suffer as a result of your unlawful and unacceptable conduct;
3.2. instituting action against you for impairing our clients’ dignity; and
3.3. the laying of criminal charges against you so that the South African Police can investigate your conduct.
4. Having considered the extent and nature of the baseless and malicious allegations which have been made by you in respect of our client we are instructed to advise you, as we hereby do, that our clients are in the process of:
4.1. finalising the necessary documentation and information to proceed with the laying of criminal charges against you;
4.2. finalising the computation of their claim for damages whereafter the necessary proceedings will be instituted against you; and
4.3. considering additional legal and regulatory steps that may be instituted against you arising out of your unacceptable conduct and behaviour.
5. In the interim, and with a view of preventing any further damage to their reputation and interest, our clients demand that you:
5.1. draft a written apology to our clients’ satisfaction, in terms of which you apologise for and retract all of the allegations made against our clients, which apology will be taken into consideration by our clients when formulating their claim for damages;
5.2. undertake not to make any other allegations and statements relating to our clients.
6. The undertakings referred to in 5 above are required by our clients by close of business on 4 December 2020 failing which we shall procced with the necessary legal steps against you to protect our clients’ interest.
7. Al of our clients’ rights remain strictly reserved.
