The state has been ordered to respond to an application made on Mary Chiwenga’s bail proceedings by the 30th of December before 11am, revealed the accused’s representative.

The order was issued today by the judge in charge of the accused’s case.

In an interview, one of the lawyers said they failed to get bail today because of a missing record.

“We appeared before the judge but we didn’t have the record which are informed was not proof read and signed by the magistrate.

We got an adjournment to allow us to go and handle that issue” he said.

The representative added that the judge wanted to relate to that record because the matter that is coming for appeal requires the courts to look at it and decide whether or not the magistrate mis-directed himself.

The next appearance will be made on the 31st of December, 9 am.
